Children rely on the adults in their lives to keep them safe, and parents often have to trust other adults with their child’s wellbeing. When adults violate the trust bestowed on them and neglect or abuse a child in their care, someone needs to speak for the child. As a compassionate, experienced lawyer serving the entire state of Michigan from his office in Flint, Attorney Michael Behm has been a voice for hundreds of injured children for decades. He fights to hold negligent and abusive adults responsible for compensating the children they have harmed.

Who Can Be Made to Pay When a Child Is Injured

Harming a child is a criminal offense, and when the justice system works, people who hurt children are sent to jail. While punishing an abuser might teach him a lesson and protect other children from harm, it does nothing to help the injured child recover and live a full life. The only way to do that is to hold liable parties financially responsible for the damage that has been done.

Liability for neglect and abuse injuries can be shared between the adult who harmed the child and his or her employer, who often carries liability insurance for just such a purpose. Examples include:

  • Schools and day care centers. When a teacher or childcare provider intentionally or neglectfully harms a child in their care, the school or day care center that employs them can be sued for damages.
  • Churches and athletic organizations. Clergy members, coaches, and athletic trainers all have unsupervised access to children. When these trusted adults abuse or neglect a child, their governing bodies can be held civilly liable.
  • Mandated reporters. Professionals who regularly interact with children have a responsibility to identify signs of abuse and neglect and a legal obligation to report suspicions of abuse. When they fail to protect a child, they can be held liable in much the same way as the abuser.

As an adult who cares for a child in Michigan—whether you are a parent, grandparent, guardian, or juvenile dependency court official—you don’t have to be concerned with who is liable in the case. All you have to do is tell your story to Attorney Michael Behm, and he will take it from there. His home base is Flint, but he travels the state meeting with victims and their families.
